The training rule on being angry about a legal issue 11. Adhikaraṇakupitasikkhāpada
Origin story
At one time the Buddha was staying at Sāvatthī in the Jeta Grove, Anāthapiṇḍika’s Monastery. Tena samayena buddho bhagavā sāvatthiyaṁ viharati jetavane anāthapiṇḍikassa ārāme. At that time the nun Caṇḍakāḷī was angry that she had lost a legal case, saying, Tena kho pana samayena caṇḍakāḷī bhikkhunī kismiñcideva adhikaraṇe paccākatā kupitā anattamanā evaṁ vadeti—“The nuns are acting out of favoritism, ill will, confusion, and fear.” “chandagāminiyo ca bhikkhuniyo, dosagāminiyo ca bhikkhuniyo, mohagāminiyo ca bhikkhuniyo, bhayagāminiyo ca bhikkhuniyo”ti.
The nuns of few desires complained and criticized her, Yā tā bhikkhuniyo appicchā …pe… tā ujjhāyanti khiyyanti vipācenti—“How can Venerable Caṇḍakāḷī say such things just because she’s angry that she has lost a legal case?” “kathañhi nāma ayyā caṇḍakāḷī kismiñcideva adhikaraṇe paccākatā kupitā anattamanā evaṁ vakkhati—‘chandagāminiyo ca bhikkhuniyo …pe… bhayagāminiyo ca bhikkhuniyo’”ti …pe… “Is it true, monks, that the nun Caṇḍakāḷī says this because she’s angry?” “saccaṁ kira, bhikkhave, caṇḍakāḷī bhikkhunī kismiñcideva adhikaraṇe paccākatā kupitā anattamanā evaṁ vadeti—‘chandagāminiyo ca bhikkhuniyo …pe… bhayagāminiyo ca bhikkhuniyo’”ti?
“It’s true, Sir.” “Saccaṁ, bhagavā”ti.
The Buddha rebuked her … Vigarahi buddho bhagavā …pe… “How can the nun Caṇḍakāḷī say such things just because she’s angry that she has lost a legal case? kathañhi nāma, bhikkhave, caṇḍakāḷī bhikkhunī kismiñcideva adhikaraṇe paccākatā kupitā anattamanā evaṁ vakkhati—‘chandagāminiyo ca bhikkhuniyo …pe… bhayagāminiyo ca bhikkhuniyo’ti. This will affect people’s confidence …” … Netaṁ, bhikkhave, appasannānaṁ vā pasādāya …pe… “And, monks, the nuns should recite this training rule like this: evañca pana, bhikkhave, bhikkhuniyo imaṁ sikkhāpadaṁ uddisantu—
Final ruling
‘If a nun is angry because she has lost a legal case, saying, “Yā pana bhikkhunī kismiñcideva adhikaraṇe paccākatā kupitā anattamanā evaṁ vadeyya—“The nuns are acting out of favoritism, ill will, confusion, and fear,” ‘chandagāminiyo ca bhikkhuniyo, dosagāminiyo ca bhikkhuniyo, mohagāminiyo ca bhikkhuniyo, bhayagāminiyo ca bhikkhuniyo’ti, then the nuns should correct her like this: sā bhikkhunī bhikkhunīhi evamassa vacanīyā—“Venerable, just because you’re angry that you’ve lost a legal case, don’t say, ‘māyye, kismiñcideva adhikaraṇe paccākatā kupitā anattamanā evaṁ avaca—‘The nuns are acting out of favoritism, ill will, confusion, and fear.’ chandagāminiyo ca bhikkhuniyo dosagāminiyo ca bhikkhuniyo mohagāminiyo ca bhikkhuniyo bhayagāminiyo ca bhikkhuniyoti. Perhaps it’s you who are acting out of favoritism, ill will, confusion, and fear.” Ayyā kho chandāpi gaccheyya, dosāpi gaccheyya, mohāpi gaccheyya, bhayāpi gaccheyyā’ti. If that nun continues as before, the nuns should press her up to three times to make her stop. Evañca sā bhikkhunī bhikkhunīhi vuccamānā tatheva paggaṇheyya, sā bhikkhunī bhikkhunīhi yāvatatiyaṁ samanubhāsitabbā tassa paṭinissaggāya. If she then stops, all is well. Yāvatatiyañce samanubhāsīyamānā taṁ paṭinissajjeyya, iccetaṁ kusalaṁ; If she does not stop, then after the third announcement that nun too has committed an offense entailing sending away and suspension.’” no ce paṭinissajjeyya, ayampi bhikkhunī yāvatatiyakaṁ dhammaṁ āpannā nissāraṇīyaṁ saṅghādisesan”ti.

- that nun who speaks thus. yā sā evaṁvādinī bhikkhunī.

other nuns who see it or hear about it. They should correct her like this: aññāhi bhikkhunīhi. Yā passanti yā suṇanti tāhi vattabbā—
“Venerable, just because you’re angry that you’ve lost a legal case, don’t say, “māyye, kismiñcideva adhikaraṇe paccākatā kupitā anattamanā evaṁ avaca—‘The nuns are acting out of favoritism, ill will, confusion, and fear.’ ‘chandagāminiyo ca bhikkhuniyo …pe… bhayagāminiyo ca bhikkhuniyo’ti. Perhaps it’s you who are acting out of favoritism, ill will, confusion, and fear.” Ayyā kho chandāpi gaccheyya …pe… bhayāpi gaccheyyā”ti.
And they should correct her a second Dutiyampi vattabbā. and a third time. Tatiyampi vattabbā. If she stops, all is well. Sace paṭinissajjati, iccetaṁ kusalaṁ; If she does not stop, she commits an offense of wrong conduct. no ce paṭinissajjati, āpatti dukkaṭassa. If those who hear about it do not say anything, they commit an offense of wrong conduct. Sutvā na vadanti, āpatti dukkaṭassa.
That nun, even if she has to be pulled into the Sangha, should be corrected like this: Sā bhikkhunī saṅghamajjhampi ākaḍḍhitvā vattabbā—
“Venerable, just because you’re angry that you’ve lost a legal case, don’t say, “māyye, kismiñcideva adhikaraṇe paccākatā kupitā anattamanā evaṁ avaca—‘The nuns are acting out of favoritism, ill will, confusion, and fear.’ ‘chandagāminiyo ca bhikkhuniyo …pe… bhayagāminiyo ca bhikkhuniyo’ti. Perhaps it’s you who are acting out of favoritism, ill will, confusion, and fear.” Ayyā kho chandāpi gaccheyya …pe… bhayāpi gaccheyyā”ti.

“And, monks, she should be pressed like this. “Evañca pana, bhikkhave, samanubhāsitabbā. A competent and capable nun should inform the Sangha: Byattāya bhikkhuniyā paṭibalāya saṅgho ñāpetabbo—
‘Please, Venerables, I ask the Sangha to listen. The nun so-and-so, because she’s angry that she has lost a legal case, says this: ‘Suṇātu me, ayye, saṅgho. Ayaṁ itthannāmā bhikkhunī kismiñcideva adhikaraṇe paccākatā kupitā anattamanā evaṁ vadeti— “The nuns are acting out of favoritism, ill will, confusion, and fear.” “chandagāminiyo ca bhikkhuniyo… pe… bhayagāminiyo ca bhikkhuniyo”ti. And she keeps on saying it. Sā taṁ vatthuṁ na paṭinissajjati. If the Sangha is ready, it should press her to make her stop. Yadi saṅghassa pattakallaṁ, saṅgho itthannāmaṁ bhikkhuniṁ samanubhāseyya tassa vatthussa paṭinissaggāya. This is the motion. Esā ñatti.
Please, Venerables, I ask the Sangha to listen. Suṇātu me, ayye, saṅgho. The nun so-and-so, because she’s angry that she has lost a legal case, says this: Ayaṁ itthannāmā bhikkhunī kismiñcideva adhikaraṇe paccākatā kupitā anattamanā evaṁ vadeti—“The nuns are acting out of favoritism, ill will, confusion, and fear.” “chandagāminiyo ca bhikkhuniyo …pe… bhayagāminiyo ca bhikkhuniyo”ti. And she keeps on saying it. Sā taṁ vatthuṁ na paṭinissajjati. The Sangha presses her to make her stop. Saṅgho itthannāmaṁ bhikkhuniṁ samanubhāsati tassa vatthussa paṭinissaggāya. Any nun who approves of pressing her to make her stop should remain silent. Yassā ayyāya khamati itthannāmāya bhikkhuniyā samanubhāsanā tassa vatthussa paṭinissaggāya, sā tuṇhassa; Any nun who doesn’t approve should speak up. yassā nakkhamati, sā bhāseyya.
For the second time I speak on this matter … Dutiyampi etamatthaṁ vadāmi …pe… For the third time I speak on this matter … tatiyampi etamatthaṁ vadāmi …pe….
The Sangha has pressed nun so-and-so to stop. Samanubhaṭṭhā saṅghena itthannāmā bhikkhunī tassa vatthussa paṭinissaggāya. The Sangha approves and is therefore silent. I’ll remember it thus.’” Khamati saṅghassa, tasmā tuṇhī, evametaṁ dhārayāmī’”ti.
After the motion, she commits an offense of wrong conduct. Ñattiyā dukkaṭaṁ. After each of the first two announcements, she commits a serious offense. Dvīhi kammavācāhi thullaccayā. When the last announcement is finished, she commits an offense entailing suspension. Kammavācāpariyosāne āpatti saṅghādisesassa. For one who commits the offense entailing suspension, the offense of wrong conduct Saṅghādisesaṁ ajjhāpajjantiyā ñattiyā dukkaṭaṁ. and the serious offenses are annulled. Dvīhi kammavācāhi thullaccayā paṭippassambhanti.

- this is said with reference to the preceding offenses. purimāyo upādāya vuccati.
- After the third announcement: Yāvatatiyakanti
- there is an offense when she has been pressed for the third time, not as soon as the misconduct has been committed. yāvatatiyaṁ samanubhāsanāya āpajjati, na saha vatthujjhācārā.
- Entailing sending away: Nissāraṇīyanti
- she is sent away from the Sangha. saṅghamhā nissārīyati.
- Suspension: Saṅghādisesoti
- … Therefore, too, it is called an offense entailing suspension. …pe… tenapi vuccati saṅghādisesoti.
Permutations
If it is a legitimate legal procedure, and she perceives it as such, and she does not stop, she commits an offense entailing suspension. Dhammakamme dhammakammasaññā na paṭinissajjati, āpatti saṅghādisesassa. If it is a legitimate legal procedure, but she is unsure of it, and she does not stop, she commits an offense entailing suspension. Dhammakamme vematikā na paṭinissajjati, āpatti saṅghādisesassa. If it is a legitimate legal procedure, but she perceives it as illegitimate, and she does not stop, she commits an offense entailing suspension. Dhammakamme adhammakammasaññā na paṭinissajjati, āpatti saṅghādisesassa.
If it is an illegitimate legal procedure, but she perceives it as legitimate, she commits an offense of wrong conduct. Adhammakamme dhammakammasaññā, āpatti dukkaṭassa. If it is an illegitimate legal procedure, but she is unsure of it, she commits an offense of wrong conduct. Adhammakamme vematikā, āpatti dukkaṭassa. If it is an illegitimate legal procedure, and she perceives it as such, she commits an offense of wrong conduct. Adhammakamme adhammakammasaññā āpatti dukkaṭassa.
Non-offenses
There is no offense: Anāpatti—if she has not been pressed; asamanubhāsantiyā, if she stops; paṭinissajjantiyā, if she is insane; ummattikāya, if she is the first offender. ādikammikāyāti.
The eleventh offense entailing suspension is finished. Aṭṭhamasaṅghādisesasikkhāpadaṁ niṭṭhitaṁ.
